Boarding house tenancy

In this section you will find information about boarding house tenancies.

The Residential Tenancies Act 1986 is the principal Act relating to residential tenancies and defines the rights and responsibilities of landlords and tenants of residential properties.

The Residential Tenancies Amendment Act 2010 made some important changes including extending the Act's coverage to include boarding house landlords and tenants. This became law on 1 October 2010.

This creates new rights and obligations for boarding house landlords and tenants, which must be observed.

A boarding house is a residential premises that contains one or more boarding rooms, with facilities for communal use by the tenants and is occupied, or intended to be occupied by at least six tenants at any one time.

A boarding house tenancy is a residential tenancy in a boarding house that is intended to last 28 days or more. The boarding house tenant is granted exclusive rights to occupy particular sleeping quarters and has the right to shared use of the facilities, such as kitchen and bathroom.
