Notice of chief executive initiated determination under the Building Act 2004
11 May 2012: The chief executive of the Department of Building and Housing has given a direction under section 181(1) of the Building Act 2004:
(a) that it is considered necessary for the purposes of the Building Act 2004 to determine whether the provisions of Subpart 6 of the Building Act 2004 concerning earthquake-prone buildings apply to buildings where only a part of the building is considered earthquake-prone;
(b) that the determination will be on the initiative of the chief executive without an application for determination being made under section 177 of the Building Act 2004;
(c) that the determination will be in respect of the matter of the exercise of power by the Gisborne District Council on 16 February 2010 to issue a notice under section 124 of the Building Act 2004 that the parapets on the building at 306 Gladstone Road, Gisborne (Lot 2 DP3646), were believed to be earthquake-prone (as defined in section 122 of the Building Act 2004) and requiring the parapets to be strengthened or a report provided to the Gisborne District Council by a Chartered Professional Engineer that the parapets are not earthquake-prone.
